Measure 5a: Establish a
Post-Construction Stormwater
Management Program
“Develop, adopt by ordinance (or similar regulatory
mechanism), implement, and enforce a program to address stormwater runoff
from new development and redevelopment. The ordinance must be reviewed and
approved by the Director prior to implementation. Ensure that controls are
in place to prevent or minimize water quality impacts.”
The UNC School of Government's Environmental Finance
Center, in cooperation with the League of Municipalities and the
Association of County Commissioners, has developed a
draft model local ordinance for the Phase II stormwater regulations for
North Carolina. Local governments can use the model ordinance to develop a
post-construction program that that complies with the requirements of
Phase II stormwater regulations.
The model ordinance gives local governments options for
the post-construction component of the Phase II rules, taking into
consideration the unique characteristics of Phase II communities, such as
geographic, political, budgetary, and staffing resources, as well as
existing programs that complement a post-construction program or can serve
as elements of such a program. The draft model ordinance was developed in
consultation with numerous stakeholders, including local governments,
engineers, environmental advocates, the development community, and DWQ
staff.
Per
Senate Bill 1210, each Phase
II local government must have its post-construction stormwater management
ordinance in place within two years of its permit issuance date. |
